Disobedience to court judgment on ObolloAffor land dispute, CLO writes IGP – From Our Correspondent

 

A rights group, the Civil Liberties Organization (CLO), Enugu state chapter, has urged the Inspector General of Police (IGP), Kayode Egbetokun, to enforce the court judgment which declared the Obollo community in Udenu Local Government Area of the state, as the rightful owners of the disputed Agu Ezeme land located in ObolloAffor in the same council area.

According to CLO, the court had further ruled that the defendants in the suit, the Livestock Traders Association, are tenants on the said land, rather than owners.

The group in an open letter addressed to the IGP, and signed by Kindness Jonah, accused the police of hindering the execution of the court judgment which favored the Obollo community.

The open letter titled “Threat to life and social order in ObolloAffor community in Enugu State,” made available to SummitNews, reminded the IGP that counsel to the Obollo community, Obi K. Odo, had earlier written to inform him (IGP) about the disobedience to the court judgment and the continued claim of ownership of the land by the Livestock Traders Association.

According to CLO, the IGP on receipt of the counsel’s petition directed the AIG Zone 13 Ukpo, in Anambra state, to investigate the matter and report back to him.

The rights group said the report of the investigation is lying fallow in the office of the IGP, and urged him to urgently implement same.

The open letter read: ”One Mr. Prince Matthew Onyebuchi Agu (080 370 755 90) , a native of Obollo Community in Enugu State, who CLO would hereinafter, refer to as The Complainant , came to CLO and reported a case of willful abnegation of court judgment and resultant loss of social and communal peace in Obolloafor over a piece of communal land which was maliciously hijacked by members of Livestock Traders in Obollorafor duly represented by Mr. Basil Odo against the standing court ruling that they are only tenants not owners of the land, but that the land is rightfully owned by members of Obollo community as represented by their elders led by Prince Matthew Onyebuchi Agu (080 370 755 90 ) .

“All views expressed hereunder by CLO are from the brief to CLO by The Complainant.

“Refers : A Letter to you dated 20th January, 2024 by Obi K. Odo Esq. of Odo , Odo Law Consult –Solicitors and Advocates on behalf of their client : Oha -in -Council and People of Obollo Clan in Udenu Local Government Area of Enugu State as duly represented in brief by Prince Matthew Onyebuchi Agu, titled: CRY FOR TO SAVE THE PEOPLE OF OBOLLO FROM IMMINENT DOOM IN THE HANDS OF SUPOL JUSTICE ATTA, SUPOL UFFETE AND CLARA, ALL OF THE LEGAL DEPARTMENT AT THE STATE CID ENUGU IN COLABORATION WITH A FORMER GOVERNOR OF ENUGU STATE , A SERVING DIG OF POLICE AND THEIR COHORTS OVER AN OBOLLO COMMUNAL LAND CALLED AGU EZEME LAND .

“CLO was duly informed by The Complainant that you directed AIG Zone 13, Ukpo to do a thorough investigation of the matter penciled down in clear petition to you by The Complainant with his group, and Zone 13 Ukpo exactly did as you had directed them , and the FINDINGS were passed to you as legally required for unreserved implementation, and this Note of Findings ,as CLO gathered from The Complainant , is traceable to the Principal Staff Officer 2, DC Asuquo Effiong, right there in your exalted office at Force Headquarters, Abuja.

“Sir, considering your zenith position in maintenance of order in security upkeep in Nigerian Nation, one would have expected a clear and strict adherence to your express directive.

.”But CLO would adduce that it appears that, though subject to verification by you, that a clandestine hand is rocking the boat to the implementation of the Report by AIG Zone 13 Ukpo you duly instructed .

“CLO then asks :

“1. Who done it ?

“2. Who is that green snake under the green grass right there in your trusted office frustrating the implementation of this Report ?

“3. Who is the sponsor of this illegality at Obolloafor?

“4. Who is sitting on the implementation of this Report right there in your glorious office at Abuja?

“5. Where is then the Rule of Law in this case?

“6. Who is the serving DIG of Police mentioned by Odo, Odo Law Consult that is frustrating peace and fomenting trouble in Agu Eleme communal land in Obolloafor community ?

“7. CLO was duly informed by The Complainant that currently Oha Obollo has been earmarked for elimination using the same Enugu State Police Command on the orders of the same serving DIG of Police and his cohorts who has blatantly refused to obey court judgment which has allowed peace to return to Obollo Clan by their upturning the court judgment and subsequently aberrantly turning The Complainant into a suspect of arson.

“This matter is currently going on in Enugu State Police Command . Since the said DIG and his cohorts have clearly refused to obey court order in judgment that the land in dispute—AGU EZEME , clearly belongs to the people of Obollo Clan as duly represented by The Complainant with his Council of Elders of Obollo Clan.

“CLO from the brief by The Complainant, can very clearly and authoritatively assert that the aim of this brazen illegality of disrespecting Court ruling by Enugu State Police Command on the orders of the same DIG of Police is to pave way for the same DIG of Police and his cohorts to AQUIRE Agu Ezeme land by foul means from the People of Obollo Clan who have the court judgment to their side.

“CLO asserts that this action by Enugu State Police Command on the orders of the same DIG of Police is a clear contravention of democratic ethos, and has to be STOPPED by You , Sir, –The Inspector General of Police.
CAVEAT
“CLO wants to remind Your Honour, that this case has been duly determined (adjudicated on) by a court of competent jurisdiction in favour of the people of Obolloafor as divulged to CLO by their Representative , who doubles as The Complainant to CLO, who also is the head of the plaintiffs in the suit as can be verified from the suit No. MOB /2/2021 delivered by Mr. N.I.C. Ngwu of Obolloafor Magistrate Court on Tuesday the 21st day of September, 2023 over which a cost (damages) on N100, 000 was awarded against the defendants represented by Mr. Basil Odo .

“It is based on this that the enemies of peace in Obolloafor community led by whoever is the serving DIG of Police and his cohorts set aside the court ruling, and started fomenting disunity in Obolloafor which made the Complainant and his members of Obolloafor community to petition you , over which you rightfully directed AIG Zone 13 Ukpo to investigate and report to you, which the Zone 13 dutifully did.

“CLO then asks: who is hampering the implementation of the Findings of this Report that was sent to you by Zone 13 Ukpo?

PRAYER OF CLO :
“CLO would want to most respectfully request Your Honour, The Inspector General of Police, to as a matter of overdue urgency, CALL UP THE REPORT OF OBOLLO PETITION AS INVESTIGATED BY AIG ZONE 13 UKPO AND ,AS PRESENTLY VERIFIABLY DOMICILED IN YOUR OFFICE ,AS CAN BE TRACEABLE TO DC ASUQUO EFFIONG ( as reported to CLO by The Complainant ) , FOR UNBIASED IMPLIMENTATION.”
